HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. Purchase will NOT increase your ability to win. The Midnight Velvet “Feeling Fabulous” Fall Makeover Contest (the “Contest”) sponsored by Midnight Velvet® (“Sponsor”) starts 12:00:01 am Eastern Time (ET) on 5/31/11 and ends 11:59:59 pm ET on 7/9/11 (the “Entry Period”). The person who submits the Entry will be referred to herein as “Entrant”. The Contest is a skill contest designed to award 2 (two) Grand Prizes to the highest scoring entrants based on the scoring of the 3 (three) Judging Criteria listed below. To enter, go online to http://www.feelingfabulousmakeover.com anytime during the Entry Period and follow the on-screen instructions: [1] Complete the registration form by providing the information required including your full name, address, city, state, Zip code, email address, date of birth and daytime phone number; [2] in the space provided on the Entry form write an essay of 600 characters or less describing why you think you should win the Contest. [3] Upload one photograph of yourself (in JPG or GIF format, file size must be less than 2 mb). Once you have completed your Entry, click the “Submit” button to enter. “Entry” is defined, for purposes of this contest, as including the Entry Form, the completed registration form, the photograph and the written essay. All entries must be submitted by 11:59:59 pm ET on 7/9/11. You may also submit your essay and photo (no larger than 8” x 10”) by mail. Include the entry form with your full name, address, city, state, Zip code, date of birth and your daytime phone number along with a hand written or typed essay of 600 characters or less and a photo as described above, and place in a stamped envelope and mail to: Feeling Fabulous Makeover Contest P. O. Box 556, Lake Bluff, IL 60044-0556. Mail entries must be postmarked by 7/9/11 and received NO LATER THAN 7/15/11. Any entries sent by messenger or overnight express delivery service will not be accepted and will be void. Proof of e-mailing or mailing does not constitute proof of delivery. Multiple Contest participants are not permitted to share the same email address.
Entrants must be females who are legal residents of the 50 United States or District of Columbia (“D.C.”), 21 years of age or older at time of entry.
Your essay must not be longer than 600 (six hundred) characters. If the essay is longer than 600 characters, only the initial 600 characters will be judged. Essay must be written in English. Each Entry must be Entrant’s own original creation, executed solely by Entrant, may not have won any previous award, been submitted in any other competition and must be a previously unpublished and previously un-produced work. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as Entrant’s original creation. Entry must be in keeping with Sponsor’s image and may not be obscene, indecent or otherwise offensive, as determined by judges or Sponsor in their sole discretion, nor can they defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights, including but not limited to intellectual property rights, and the right to submit or use same shall not be restricted. Any Entrant whose submitted material contains elements not owned by Entrant will be disqualified. Entries that are incomplete or do not comply with these Official Rules in any way are subject to disqualification. No correspondence regarding entries will be acknowledged or entered into with Entrant except as provided herein. Submission of an Entry, grants Sponsor the right to use, publish, adapt, assign, edit, dispose of, and/or modify such Entry and the concepts embodied therein in any way, in commerce and in any and all media worldwide, without limitation or compensation to the Entrant and may be required to sign a release to that effect. Submission of an Entry further constitutes the Entrant’s consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the Entry and the concepts embodied therein. Such rights, title and interest shall include, but are not limited to, all intellectual property, sales and licensing rights. Entries become the sole property of the Sponsor and will not be returned. Entrant may be required to provide, in a form satisfactory to the judge and Sponsor, appropriate legal release(s) for use of the Entrant’s and any other third party’s likeness/photograph in connection with this Contest. Personal information including name, address, city, state, zip, email, date of birth and telephone number collected from an Entrant will be used only for the purpose of judging the Contest and to notify the Entrant in the event his/her Entry is chosen as the Winner, and will not be re-used, sold or shared in any manner by Sponsor, Pinnacle Promotion Group (the “Administrator”), or any third parties unless Entrant has opted-in to receive additional information and promotional materials from Sponsor or third party. Once the promotion has ended all information supplied by entrants who opt not to receive additional information will be removed from the database.
JUDGING/NOTIFICATION: All forms of eligible entries will be judged and scored on or about August 19, 2011 by an independent judge, Maureen Burke, a nationally renowned make-up artist, under the supervision of Pinnacle Promotion Group, the Contest Administrator on the basis of the following criteria: Clarity and Originality of the essay (40%); Quality and Appearance of Photo (30%); and Makeover Potential (30%), defined as an evaluation of entrant’s “before” photo combined with the potential “after effect” of a Midnight Velvet beauty makeover to determine the two (2) Grand Prize Winners. In the case of a tie, the judge will determine entrant with the highest score for the “Clarity and Originality” criteria among the tied entrants as a Grand Prize Winner. The two Grand Prize Winners will be notified by overnight courier, mail and/or e-mail and/or telephone on or about August 19, 2011. Becoming a Winner is subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules. The Grand Prize Winners will be required to complete, sign and notarize an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, which must be returned within 4 days of date of written prize notification. Grand Prize Winners must also submit a notarized Travel Release form prior to traveling. If such documents are not returned within the stated timeframe or are returned as undeliverable, the corresponding winner will be disqualified and an alternate winner will be determined based on the judging criteria and notified as per the procedures describe above. Upon disqualification, no compensation will be given.
PRIZES (Only 2 Prizes will be awarded): Two (2) Grand Prizes: a trip for winner for a beauty makeover including haircut, color, style and make-up with Maureen Burke. Trip consists of air travel from a major airport near winner’s home to Chicago, IL; 3 days/3 nights hotel accommodations in Chicago. Trip must be taken by date specified by Sponsor. Trip must be accepted by winner “as is” and must be taken at time and flight itinerary specified by Sponsor or prize will be forfeited in its entirety. Upon forfeiture no compensation will be given. Any changes made to hotel accommodations or air travel will be at the expense of the winner. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Grand Prize Winners are scheduled to receive a videotape of their beauty makeover, ground transportation in Chicago, meals while in Chicago, a ticket to a “Broadway-style” show at a Chicago theatre and two (2) Midnight Velvet outfits and accessories including but not limited to jewelry, purse, shoes as well as M.Vie make-up, Approximate Retail Value of Grand Prize package, $2,500 each. Actual value of prize package may vary based on dates of travel and point of departure. Any difference between actual value and stated value herein will not be awarded in cash. Certain restrictions/blackout dates may apply. Winner must possess a government issued valid photo ID or other required documentation needed to travel. Airline tickets are non-refundable/non-transferable and are not valid for upgrades or frequent flyer mileage accrual. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of the Sponsor. If a winner lives within 150 miles of Chicago, ground transportation to and from winner's home may be provided in lieu of airline travel. If the beauty makeover session is cancelled or in any way abbreviated for any reason after ticketing of trip, Sponsor shall have no liability or further obligation to the winner other than to supply the trip as described herein, with no further compensation being paid in exchange therefore. Terms and conditions of Chicago theatre tickets will apply and will not be replaced if damaged or lost. Sponsor reserves the right to substitute the prize for one of equal approximate retail value or comparable use for any reason. The winners are responsible for providing travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledges that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. All other expenses not stated herein as part of the prize are the winner’s sole responsibility. Winner is responsible for payment of all applicable income taxes on prize and will receive a 1099 Tax Form for the actual value of the prize to file with the IRS for the 2011 tax year.
